Continuation Permit
A Continuation Permit is a discretionary permit granted by the Planning Commission that allows legal nonconforming uses to continue past their amortization date or permit expiration date. A Continuation Permit supersedes any existing permit but incorporates existing permit conditions and may impose additional conditions in order to meet the standards for granting Continuation Permits. Continuation Permits for Nonconforming Uses and Structures may only be granted when the Planning Commission finds that:
- Special circumstances apply to any such use or structure that do not apply generally to other uses and structures in the same vicinity and zone and
- The continuance is not detrimental to the public interest, health, safety, convenience, or welfare.
